案情简介2005年1月27日,北京市海淀区的于女士与时空文化公司签订了《家教服务协议》,时空文化为于女士的女儿杨小娜(化名)进行课外辅导,目标是“杨小娜今年的中考成绩达到北京市重点高中录取分数线”。同时双方还约定,如协议到期时,未能达到时空文化承诺的目标,该中心有权对杨小娜进行测试,测试题目范围不超出该中心提供的复习内容及国家教学大纲。如果测试的各科平均成绩在91分到100分之间则100％退款,86分到90分之间退款75％,81分到85分之间退款50％,在0分到80分之间不退款。 第二天,于女士交纳了家教服务费人民币1．29万元。从2005年2月6日到6月21日期间,时空文化指派家教老师对杨小娜进行辅导,但是7月初公布的中考成绩显示,杨小娜的成绩没有达到家教服务协议约定的服务目标。于是,于女士向时空文化提出退还家教服务费。时空文化组织杨小娜参加了由该中心组织的测试,测试结果没有达到合同约定的退款条件,时空文化据此拒绝退款。为此,于女士将时空文化诉至法院。
