目前,我国食品安全现状形势不容乐观,食品安全的监管制度力不从心。现行的食品安全监管体系运行不畅,制度设计未能契合于各地实际是其根本。食品安全监管体系中,企业和消费者是最为重要的两大民事主体。食品安全监管体系并不是单纯的行政执法体系,其应立足于企业和社会和谐发展,着眼于企业迎承担起社会责任,着力于保护消费者合法权益。企业的社会责任应包括两个方面,一是具有强制执行力、约束力的责任;二是道德层面上的、应有企业主体自觉恪守的责任。
At present, the current situation of food safety in our country is not optimistic, and the regulatory system for food safety is powerless. The current food safety regulatory system is running sluggishly, and the failure of the system design to fit in with the actual conditions is the fundamental issue. Food safety regulatory system, enterprises and consumers are the two most important civil subject. Food safety regulatory system is not a simple system of administrative law enforcement, which should be based on the harmonious development of enterprises and society, focusing on enterprises to meet their social responsibilities, focus on protecting the legitimate rights and interests of consumers. The corporate social responsibility should include two aspects, one is the obligation of enforcement and binding; the other is the moral level, there should be consciously abided by the responsibility of business entities.
