“理性”概念的运用,对于以西方为先导的近现代人类法律文明制度的形成、发展所起的推进作用是巨大的。自从西方启蒙思想家倡导理性立法以来,近现代西方法律就被宣布建立在“理性”之上。当中国最初因被西方的洋炮轰开紧闭的关锁,而极不情愿地迈开走向现代化的蹒跚步履时,中国人并不清楚法律制度现代化以及作为它的思想先导的理论观念现代化的意义。在“中学为体、西学为用”的精神主导下,“理性”概念虽有人提及,却终因响应者寥落而归于寂寞,更无形成民族新意识、国家新制度的可能。正如西方的现代工业文明并不专属于西方一样,肇源于西方的现代法律制度、首倡于西方的现代理性精神也不专属于西方。“理性”是全人类的理性。然而至今为止,中国法学的主流理论对法律的精神实质的阐释仍满足于统治阶级的意志说,而对“理性”并无认真关注。因此研究、阐发“理性”精神,使之贯穿于我们的法律形成、法律运作的全过程,乃至深入民族意识之中,是一项具有深刻意义并且任重而道远的工作。
The use of the concept of “rationality” is tremendous for the promotion of the formation and development of the modern civilized legal civilizations led by the West. Since Western enlightenment thinkers advocated rational legislation, modern Western law was declared to be based on “reason.” When China was initially reluctant to embark on the tumultuous closure of modernization by the western artillery shelling, the Chinese did not understand the modernization of the legal system and the modernization of the theoretical concept as the precursor to its thinking significance. Under the “middle school as the body, Western learning for the use” spirit, although the concept of “rationality” was mentioned, it eventually fell to loneliness due to the sparseness of the respondents, without any possibility of forming a new national awareness and a new national system. Just as the modern industrial civilization in the West does not belong exclusively to the West, it originated in the modern Western legal system. The spirit of modern rationality advocated by the West is not exclusively Western. “Reason” is the rationality of all mankind. However, so far, the mainstream theory of Chinese jurisprudence interprets the spiritual essence of law as being still satisfied with the will of the ruling class, while not paying any serious attention to “reason.” Therefore, it is a profound and far-reaching task to study and elucidate the “rational” spirit so that it will permeate the entire process of our legal formation, legal operation and even our national consciousness.
