1965年《解决国家与他国国民之间投资争议公约》(以下称《华盛顿公约》)的订立和依此设立的“解决投资争议国际中心”(即ICSID)是为了给主权国家与他国投资者之间的争端提供调解和仲裁的利便。其规定的承认与执行裁决程序简洁,条件宽泛,形成了独特的机制。中国作为《华盛顿公约》的缔约国之一,且在近些年来与他国签订的双边投资条约中大多允许外国投资者将投资争端提交ICSID管辖,因此与ICSID的关系越来越密切。但其承认与执行机制并不是十全十美的,现实中仍存在很多问题。本文从这些问题入手,分析ICSID仲裁裁决承认与机制存在的不足及对策,并阐释其对我国的启示,旨在保护我国政府利益及海外投资者利益的同时,树立我国开放的、负责任的大国形象。
The International Center for Settlement of Investment Disputes (ICSID) established and concluded pursuant to the 1965 Convention on the Settlement of Investment Disputes between States and Nationals of Other Countries (hereinafter referred to as “the Washington Convention”) is intended to give sovereign countries and other countries investment The dispute between the parties provides the convenience of mediation and arbitration. The provisions of its recognition and enforcement of adjudication procedures concise, conditions are wide, forming a unique mechanism. As one of the signatory states to the Washington Convention, most of the bilateral investment treaties signed with other countries in recent years allow foreign investors to submit their investment disputes to the jurisdiction of ICSID. As a result, China has closer relations with ICSID. However, its recognition and enforcement mechanism are not perfect. There are still many problems in reality. Based on these problems, this article analyzes the deficiencies and countermeasures of the recognition and mechanism of ICSID arbitral awards, and expounds its enlightenment to our country, aiming at protecting the interests of our government and the interests of overseas investors and establishing an open and responsible big country Image.
