食品安全社会共治的理念强调社会公众参与食品安全治理的重要作用,认为公众和政府、企业等都是食品安全共治的主体。但是,目前我国食品安全相关法律制度对食品安全社会共治中公众参与主体的范围界定并不明确,影响了公众参与的实践效果。因此,在食品安全法律中明确公众参与主体的范围及界定标准,有助于社会公众实质性参与的实现,并进一步推动食品安全社会共治格局的形成。
The concept of social co-governance in food safety emphasizes the important role of the public in participating in food safety governance and holds that the public, government, and enterprises are all subjects that co-ordinate food safety. However, at present, the legal system of food safety in China defines the scope of the public participation in food safety society is not clear, affecting the practical effect of public participation. Therefore, clarifying the scope and definition of the main body of public participation in the food safety law will help substantive participation of the public and will further promote the formation of a common governance structure for food safety.
