香港《环境影响评估条例》于1998年4月1日开始实施,其目的是评估条例中列明的指定工程项目对环境的影响,以避免不良影响或将影响减至可接受水平。该条例的独特之处包括:条例下订有《环境影响评估程序的技术备忘录》,制定了明确统一的环评技术指引和准则;两个阶段咨询公众及环境咨询委员会,以确保中立及公信性;设立条例网页,以增加透明度;香港环境保护署颁发的环境许可证具有法律效力,确保工程项目倡议人在工程项目的设计、建造和营办期间落实许可证上列明的设计要求、缓解措施和环境监察及审核计划;订立了严厉的违法罚则。后期,香港环境保护署将不时检讨环评制度,并推行优化措施,提高该条例的客观性和成效。
The Environmental Impact Assessment Ordinance of Hong Kong came into operation on April 1, 1998 with the purpose of assessing the environmental impact of the designated projects specified in the Ordinance so as to avoid adverse effects or reduce the impact to an acceptable level.
