法律行为的目的在于法律效果的实现,在于法律制度以承认该意思表示的方式而于法律中实现行为人所欲求的法律后果。因而大多数的法律行为都是有因行为,但也存在相当数量的无因行为,其中学者们争论最多的就是有关物权行为的无因性问题。为此,本文将阐述无因性理论的一些基本情况,对物权行为的无因性进行初步的辨析。
The purpose of the legal act is to realize the legal effect, that is, the legal system realizes the legal consequence of the perpetrator ’s desire in the law by admitting the way of expressing the intention. Therefore, most of the legal acts are causal behavior, but there are also a considerable number of causative behavior, among them the most controversial scholars is the non-causal issues related to the real right behavior. To this end, this article will explain some of the basic situation of non-cause theory, the non-causal analysis of real rights and actions.
