推进依法行政,建设法治政府不仅要求行政机关合法合理行政,而且要求行政机关行使公权力应当做到程序正当。这些要求的实现虽然很大程度上或最终要诉诸于行政机关及其公务人员的自觉和自律,但最根本的还是靠行政程序违法法律责任追究机制威慑和行政诉讼的司法审查监督。 To promote administration according to law and build a government ruled by law not only requires the administrative organs to legally and reasonably administer their duties, but also demands that administrative organs should exercise due process of procedures in exercising public power. Although the realization of these requirements is largely or ultimately resorted to the conscious and self-discipline of the administrative organs and their civil servants, the most fundamental thing is to rely on the deterrence of mechanisms for investigating the legal liability of administrative procedures and the judicial review and supervision of administrative litigation.
