随着社会矛盾的不断加剧,引发了“诉讼爆炸”和信访“高温不退”的现象。这种现象一方面增加了法院法官的工作压力,另一方面还容易引起人民与公职人员的社会矛盾,因而亟待改进。同时,也反映出社会运行不畅通、社会矛盾处理机制较为单一等问题。因而,建立多元化、多角度的纠纷解决机制在构建和谐社会的进程中就显尤为重要。行政调解以其高效、快捷、低成本的特点展现了其优势。但在实践运行过程中,没有任何制度是完美无瑕的,行政调解也不例外,本文针对行政调解运行中存在的诸多问题逐一提出完善建议,使其能够更好的发挥作用。
With the continuous intensification of social contradictions, the phenomenon of “litigation explosion” and letters and visits “hot and cold” triggered. This kind of phenomenon not only increases the working pressure of the court judge on the one hand, but also easily causes the social conflicts between the people and the public officials. Therefore, it urgently needs improvement. At the same time, it also reflects the problems of imperfect social operation and relatively simple handling of social conflicts. Therefore, establishing a pluralistic and multi-angle dispute resolution mechanism is particularly important in the process of building a harmonious society. Administrative mediation shows its advantages with its high efficiency, quickness and low cost. However, in practice, no system is flawless, and administrative mediation is no exception. In this paper, we put forward perfect suggestions one by one for many problems in administrative mediation so that they can play a better role.
