美国是世界上反恐制度较为成熟的国家之一,其认定模式和程序制定具有可借鉴性。美国以行政认定程序为主,将程序细分为指定程序、除名程序和审查程序。美国国务卿在认定程序中发挥了巨大的作用,同时各个相关的行政机关协调配合,行政效率较高,然而其认定程序在程序正当性方面存在违宪的缺陷。本文认为结合美国实践的成熟经验,避免其不足之处,是我国完善反恐认定工作的一种可行的途径。
The United States is one of the countries in the world where the anti-terrorism system is relatively mature. Its recognition model and procedure formulation can be used for reference. The United States mainly focuses on administrative certification procedures, which are subdivided into designated procedures, delisting procedures and review procedures. The Secretary of State of the United States has played a huge role in the accreditation process. At the same time, all relevant administrative agencies are coordinated and administratively administratively highly effective. However, their accreditation procedures are unconstitutional in procedural legitimacy. This article argues that combining the mature experience of the United States practice and avoiding its deficiencies is a feasible approach for perfecting the anti-terrorism recognition work in our country.
