现代物业管理中物业公司负有的安全保障义务的性质素来有合同义务、附随义务、法定义务等不同认识。现有立法直接涉及物业管理安全保障的仅有物业管理条例中个别条款规定,多是在侵权法、合同法等立法中针对一般民事活动中安全保障义务的规定。基于不同性质的义务的优劣分析,结合我国现有立法模式,认为现代物业管理中安全保障义务应界定为法定义务,同时不排除法定标准之上的约定。
Property management in the modern property management companies have always had the nature of the obligation to ensure that the contract obligations, with obligations, statutory obligations and other different understandings. The existing legislation directly relates to the security of property management. Only the individual provisions in the property management regulations are mostly the provisions on the security obligations in civil activities in tort law and contract law. Based on the analysis of advantages and disadvantages of obligations of different nature and combining with the existing legislative mode in our country, the author believes that the obligation of safeguarding security in modern property management should be defined as a statutory obligation while not excluding the agreement above statutory standards.
