随着社会经济的发展和人们生活水平的日益提高,私家车的数量呈现出急剧上升的趋势。与此同时,土地资源的紧缺致使中、高层住宅小区应运而生,并不断增多。由此引发了有关住宅小区地下车库的一系列纠纷。究其主要原因在于地下车库的产权归属不明晰。为此,本文从纠纷的社会缩影入手,在分析有关地下车库产权归属之理论支点——建筑物区分所有权及地下车库与整栋住宅楼的法律关系等内容的基础之上,试图阐明地下车库产权归属的确认问题。
With the development of society and economy and the improvement of people’s living standards, the number of private cars has shown a sharp upward trend. At the same time, the shortage of land resources led to the emergence of medium and high-rise residential quarters and increased. This triggered a series of disputes about the underground garage in residential quarters. The main reason is that the ownership of underground garage ownership is not clear.
