本文以元杂剧和明代小说中的陈州粜米故事为例,探讨了元明文学中包公的形象和故事的转变及由此所反映出的民间对法律的认知。通过分析“金牌”这一代表包公形象的重要道具和不同时期作品中诉讼程序的变化,指出:在包公故事中,文学虚构与制度现实息息相关;在元明时期,人们对法的诉求其实是对权力的诉求;而在民间的法律认知中,程序占有重要地位。
This paper takes the drama of Chenzhou and Mi in Yuan Dynasty dramas and novels of Ming Dynasty as an example to discuss the transformation of Baogong’s images and stories in Yuan and Ming dynasties as well as the folk cognition of law reflected by it. By analyzing the important prophecy of “gold medal” and the change of litigation procedure in different periods, it points out that in the story of Bao Gong, literary fiction is closely related to the reality of the system; in the Yuan and Ming Dynasties, Is the appeal of power; while in civil law cognition, the procedure occupies an important position.
