19世纪末,面对劳资冲突增多、现存集体谈判立法无法有效解决劳资争议的状况,在新自由主义思想的影响下,英国政府于1896年出台《调解法》。法案遵循民间集体谈判中的自愿原则,允许政府部门协助解决劳资纠纷,加强了政府在劳资关系中的协调作用。法案对于劳资争议的解决发挥了重要作用,推动了集体谈判制的发展,为发展良性的劳资关系创造了条件。
In the late 19th century, in face of the increase of labor-capital conflicts and the existing collective bargaining legislation, it was impossible to effectively solve the situation of labor-capital disputes. Under the influence of neoliberalism, the British government introduced the Mediation Act in 1896. The bill follows the voluntary principle of non-governmental collective bargaining and allows government departments to help resolve labor disputes and strengthen the government’s coordinating role in labor relations. The bill has played an important role in resolving labor disputes, promoted the development of collective bargaining system and created the conditions for the development of benign relations between employers and employees.
