随着经济社会的快速发展,现实中出现许多由媒体、单位乃至自然人为某个人或某类特定事由而面向社会组织的募捐活动。这种因募集而发生的捐赠与受赠行为,不同于《公益事业捐赠法》所规范的特定主体受赠行为,又缺乏明确的法律规制,在实践中引发了许多争议,而学界又莫衷一是。文章将以社会募捐的含义为出发点,阐述社会募捐的特征,并着重分析社会募捐与公益捐赠的区别。
With the rapid economic and social development, many fund-raising activities for the social organizations emerge from the media, units and even natural persons for certain individuals or certain kinds of reasons. This kind of donation and donation occurred because of the fundraising, which is different from that of the specific subjects as specified in the Donation Law of Public Welfare, lacks explicit legal regulation and has caused many controversies in practice. The article will take the meaning of social fund-raising as a starting point, expounds the characteristics of social fund-raising, and focuses on the analysis of the difference between social fund-raising and non-profit donation.
