本文以自由、 选择、 责任为线索勾勒出自由主义的基本精神， 并认为自由主义的核心观点可以概括为： 自由地选择生活、 独立地承担责任。 通过论述自由主义的个人基础、 哲学基础与归责基础， 探讨自由主义作为法律归责的伦理基础与个人行为的评价机制的内容和价值所在。 文章亦介入了中西文化之比较， 对自由主义在中国语境中的困境提出反思。
In this paper, the basic spirit of liberalism is drawn from the perspectives of freedom, choice and responsibility. The core idea of liberalism can be summed up as: freedom to choose life and take responsibility independently. By discussing the individual basis, philosophical basis and imputation foundation of liberalism, this paper explores the content and value of liberalism as the ethical foundation of legal liability and the evaluation mechanism of personal behavior. The article also intervenes in the comparison of Chinese and Western cultures and reflects on the plight of liberalism in Chinese context.
