文章针对目前建设市场索赔方面,因发包人的实践经验和机会相对较少,常居于被动地位,使其在项目建设中付出了额外的费用或造成了不应有的损失。本文认为,发包人应针对建设项目设计阶段、前期建设手续办理及施工现场准备阶段、招投标及合同签订阶段、以及建设工程施工阶段的不同特征,做好各阶段的反索赔准备工作,并尽可能在项目管理全过程聘请法律咨询机构,尽量避免索赔事件的发生或将索赔的额度降到最低。
In view of the current construction market claims, due to the contractor’s practical experience and relatively few opportunities, often living in a passive position, so that it has paid an extra fee in the project construction or caused undue losses. This paper argues that the contractor should be prepared for the various stages of the anti-claims preparation for the construction project design phase, the early construction procedures and construction site preparation phase, bidding and tendering and contract signing stage, as well as the different stages of the construction project It may be in the project management process to hire legal advisory body, try to avoid the occurrence of claims or to minimize the amount claimed.
