谋杀罪是英国普通法中重要的犯罪之一,虽被立法化,但其法律定义和构成要件面临着审判实践的挑战。传统谋杀罪定义中的自然人出生、死亡及受害者死亡的时间限定等因素或受到冲击,或被予以废除。在谋杀罪因果关系方面,存有事实和法律关系、“由于”原则、促进原因、必要原因、中介行为和事件等要素或部分,但每一要素都有例外之处。谋杀罪犯罪心理——恶意预谋已不是传统意义上的,它应包含非法剥夺他人生命的故意或造成他人重伤的故意。谋杀罪的死刑刑罚被1965年的《谋杀罪法》废止后,其终身监禁的刑罚方法也受到冲击。
The crime of murder is one of the most important crimes in the common law in the UK. Although it has been legislated, its legal definition and constitutional elements face the challenge of trial practice.
