2003年11月21日,广东省高级人民法院向全省各级法院下发《关于禁止戎明昌等6名记者旁听采访我省法院案件庭审活动的通知》(粤高发[2003]252号。文中简称《通知》),该《通知》规定分属南方日报、羊城晚报、广州日报三大报业集团6家报社的6名记者自2003年11月20日至2004年11月19日禁止到广东省三级法院旁听采访案件的庭审活动。发出此《通知》的原因是1月7日和11日6家报社分别从不同角度报道了广州市中级人民法院正在审理的一宗离婚析产纠纷抗诉案。案件经广州市中级人民法院审结,广东省检察院提出抗诉,广州市中院依照审判监督程序进行再审。
On November 21, 2003, the Higher People’s Court of Guangdong Province issued to the courts at all levels in the province a Notice on Prohibiting 6 Journalists from Encountering Rongmingchang from Auditing the Trial Activities of Courts in Guangdong Province (Yue Gao Fa [2003] No. 252). Referred to as the “Notice”), which stipulates that 6 reporters belonging to 6 newspapers of Nanfang Daily, Yangcheng Evening News and Guangzhou Daily Newspaper Group shall be banned from Guangdong from November 20, 2003 to November 19, 2004 Provincial courts listen to the interview cases. The reason for the issuance of this Notice was that a case was filed on January 7 and 11 on 6 newspapers that separately reported Guangzhou City Intermediate People’s Court’s ongoing protest against divorce and miscarriage. The case was concluded by the Guangzhou Intermediate People’s Court, the Guangdong Provincial Procuratorate filed a protest, and the Guangzhou Intermediate People’s Court conducted a retrial in accordance with the procedure of trial and supervision.
