在有关少年司法的政治或学术论争中,“责任”是一个愈发重要的概念。恢复性司法理念是解决青少年犯罪另一条路径,同样也促进了有关少年司法的论争。恢复性司法鼓励罪犯解决过去的行为带来的问题,对自己将来的行为负责,强调修复损失的重要性。笔者研究了41名年轻罪犯,他们都被适用以恢复性司法为宗旨的移交令。本文考量了英国司法制度是如何适应移交令,认为恢复性司法的理论和实践存在显著差异。
In the political or academic debates on juvenile justice, “responsibility” is an increasingly important concept. The concept of restorative justice is another way to tackle juvenile delinquency and it also promotes the debate on juvenile justice. Restorative justice encourages criminals to solve the problems posed by past actions, be responsible for their own future behavior and emphasize the importance of repairing losses. The author studied 41 young offenders, all of whom were turned over to apply restorative justice. This article examines how the British justice system adapts to the transfer order, arguing that there are significant differences in the theory and practice of restorative justice.
