随着经济、社会和技术的不断发展,为顺应时代对社会管理方式创新提出的要求,在传统的以行政复议、行政诉讼为中心的行政纠纷解决机制之外,不少国家已经开始探索新的行政纠纷解决途径。在这种背景之下,我国部分地方政府摸索出市长公开电话、首长接待日、电视问政、微博问政等化解社会矛盾的新方法。作为在传统纠纷解决机制之外的探索与创新,这些新途径逻辑性并不周密。根据多元行政纠纷解决机制主、客观方面的标准来进行判断,也不完全符合行政纠纷解决机制的基本要求。但这些行政纠纷解决新途径的实践,为我国多元行政纠纷的解决注入了新的生机与活力,未来通过制度化和规范化的改革,将会发挥更加积极的作用。
With the constant development of the economy, society and technology, many countries have already started to explore new ways to meet the demands of the times for innovating social management methods. In addition to the traditional administrative dispute resolution mechanism centered on administrative reconsideration and administrative litigation, Administrative Dispute Resolution. Under this background, some local governments in our country have explored a new method of resolving social conflicts such as the mayor’s public phone call, the head of reception day, the political consultation on television, the microblogging asking for political advice and so on. As an exploration and innovation beyond the traditional dispute resolution mechanisms, these new approaches are not logical enough. According to the multiple objective administrative dispute resolution mechanism, objective criteria to judge, does not fully comply with the basic requirements of the administrative dispute resolution mechanism. However, the practice of these new forms of administrative dispute resolution has injected new vigor and vitality into the solution to the multiple administrative disputes in our country. In the future, through institutionalized and standardized reforms, we will play a more active role.
