《行政强制法》第35条对于催告时间的规定只强调了应在行政强制执行决定前,但是仍有一个时间点:行政决定履行期限届满。催告的作出时间是在履行期限届满之前还是之后,两种选择背后蕴藏着对于催告行为性质的不同理解,在实践处理中也会产生不同的效果。通过对催告的性质、《行政强制法》的立法目的、和其他国家立法的研究,认为应当将催告时间认定为在履行期限届满后作出,才更符合设置行政强制执行制度的意图。
The article 35 of the Administrative Enforcement Law only stipulates that the reminder time should be prior to the administrative enforcement decision, but there is still a time when the administrative decision expires. Whether the reminder was made before or after the expiration of the performance deadline lies behind the two choices which contain different understandings of the nature of the act of reminding and will have different effects in the practical treatment. By studying the nature of the lawsuit, the legislative purpose of the “Administrative Enforcement Law” and the research of other national legislation, it is considered that the reminder time should be deemed as being made after the expiration of the performance deadline, which is more in line with the intent of setting up an administrative enforcement system.
