举报是宪法赋予公民的一项基本权利,是公民参与民主监督,管理国家事务的一种重要方式。从检察机关成立举报中心的实践来看,举报工作实现了专门机关监督与公民的民主监督有机结合,对推动反贪污贿赂斗争的深入发展,震慑、打击、预防和减少职务犯罪发挥了极其重要的作用。随着改革开放的不断深入,我国的经济体制发生了深刻的变革,检察机关如何适应变化了的形势,加强对举报人的保护,推动反贪污贿赂斗争的深入,这是一个值得研究的课题。 一、保护举报人工作面临的新情况 随着我国社会主义市场经济的不断发展,特别是我国加入世贸组织后,我国在更大的范围和更深的程度上参与国际竞争和合作,整个社会经济成分、组织形式、就业方法、分配方式、利益关系等日益多样化,由此保护举报人工作也出现了许多新情况。 1.打击报复举报人的主体呈多元性。当前,企业领导人的产生呈现多样化。一是国有公司由上级任命或委派产生;二是股份制公司由股东大会选举产生;三是中外合资企业由投资方代表委派
Whistleblowing is a basic right conferred on citizens by the Constitution and an important way for citizens to participate in democratic supervision and administration of state affairs.
