物业服务企业对业主负有安全保障义务,该义务未履行或者履行不适当即应承担侵权责任。而根据《侵权责任法》的规定,违反安全保障义务侵权责任的类型是设施设备未尽安全保障义务和服务管理未尽安全保障义务。但物业服务企业违反安全保障义务承担侵权责任,应当依照法律进行,不能以业主等所受损害全部得到救济为标准,而应当以善良管理人的注意义务为标准,必须具备因果关系要件,并坚持过错责任原则。本文从一则案例出发,着重探讨了物业服务企业安全保障义务的来源、内涵以及违反安全保障义务承担侵权责任的界限,并对该案判决书的法律适用提出了批评意见。
Property services business owners have the obligation to protect the security, the obligation fails to perform or improper performance that should bear the tort liability. According to the Tort Liability Act, the type of tort liability that violates the obligation of safety protection is that the facility equipment fails to fulfill the obligation of safety protection and the service management fails to fulfill the obligation of safety protection. However, the property service enterprise shall bear the infringement liability in breach of the obligation of security guarantee and shall carry out the infringement liability in accordance with the law. It can not take all the relief suffered by the owner as the standard, but should take the duty of attention of the good manager as the standard, must have the causal relationship elements, Fault liability principle. Based on a case study, this paper focuses on the source and connotation of the obligation of security for property service enterprises and the boundary of liability for breach of security obligation, and puts forward some criticisms on the legal application of the case judgment.
