●农地发展权是土地发展权概念的一个子概念,土地发展权是指对土地进行再开发并获取收益的权利,而农地发展权则是指将农地变更为建设用地并获取收益的权利。在我国法律制度中,并没有明确的土地发展权和农地发展权的概念,但实际上存在着土地发展权和农地发展权问题。●农地发展权只能由国家来行使,尤其是在实行社会主义公有制且人多地少的我国。现行土地制度虽然限制了农地进入建设用地市场,但同时也保护了农地不被轻易转用和占用,保护了农地的自然属性和农业生产利用方式,保护了农民长远的农地权利。●在现实生活中,任何产权都是一定法律制度下的产权,农地所有权也不可能是绝对权利,必然要受到国家法律、社会制度乃至社会习惯的制约。
Land development rights are a sub-concept of the concept of land development rights. Land development rights refer to the right to redevelop land and obtain benefits. In our country’s legal system, there is no clear concept of land development rights and land development rights, but in fact there are issues of land development rights and land development rights. ● The right to development of agricultural land can only be exercised by the state, especially in our country where public ownership of socialism is practiced and with fewer people. Although the existing land system limits the farmland into the construction land market, it also protects the land from being easily diverted and occupied, protects the natural attributes of agricultural land and agricultural production and utilization, and protects farmers’ rights to farmland in the long run. ● In real life, any property is a property under a certain legal system. Ownership of agricultural land can not be an absolute right, and it must be subject to the laws of the country, the social system and even social habits.
