《道路交通安全法》基于道路交通管理因素,授权公安交管部门采取临时性限行措施,环保因素超越了法律授权。实践中,临时限行措施的直接效力来源,是地方政府制定的应急预案。环保部门负责大气监控和预警,有权向政府提出建议;政府听取建议,发出限行通告,作出抽象行政行为;公安交管部门服从政府行政命令,组织实施限行措施,对相对人作出具体行政行为,这是临时性限行措施的恰当程序逻辑。
The Road Traffic Safety Law, based on the road traffic management factors, empowers the public security departments to take temporary restriction measures and the environmental protection factor goes beyond legal authorization. In practice, the direct source of effectiveness of the temporary restriction measures is the contingency plan formulated by the local government. The environmental protection department is responsible for the monitoring and early warning of the atmosphere and has the right to make suggestions to the government. The government listens to suggestions, makes a notice of limit and makes abstract administrative actions. The public security and traffic control departments obey the government administrative order, organize the implementation of the measures to limit the line and make specific administrative actions against the counterparts It is the proper procedural logic for temporary restriction measures.
