行政诉讼中如何对前置行政行为进行审查,这直接关系到被诉行政行为的合法性,以及行政行为在国家法律体系中的效力、行政权与司法权的关系等带有全局性的深层次问题。由于理论界对此认识不一,立法缺乏明确规定,导致司法实务界做法各异,影响了法制的统一和裁判的公信力,从而使对前置行为的审查成为困扰行政审判的一大难题。本文从司法实用主义的视角出发,综合考察学界的不同理论观点,作出有利于实务解决的理性判断,并据此对实务通行做法进行利弊分析,对被诉行政行为中的前置行政行为的处置方式进行探讨,在此基础上提出了解决问题的设想,建立我国有限合并审查制度。
How to examine the front administrative action in administrative litigation is directly related to the legitimacy of the administrative act being sued, as well as the effectiveness of the administrative act in the national legal system, the relationship between executive power and judicial power, problem. Due to the different understanding from theorists, the legislation lacks the explicit stipulation, leads to the different practices of judicial practice, affects the unification of legal system and the credibility of judgment, so that the review of front-end behavior becomes a major challenge to administrative trial. This article, from the perspective of judicial pragmatism, comprehensively examines the different theoretical views of the academic circles and makes rational judgments that are conducive to practical solutions. Based on this, we analyze the pros and cons of practical practices, and deal with the pre-administrative actions of the accused administrative acts Ways to explore, on this basis, put forward the idea of solving the problem, the establishment of China’s limited merger review system.
