消费者反悔权是指消费者在采用网络方式购买特定商品后的法定期限内,无需说明理由即可对该完好商可予以退货的法定合同解除权。赋予消费者反悔权是改善网络购物中买卖双方信息不对称状况,实现交易公平的必然要求。本文从消费者反悔权的历史沿革谈起,并结合新消法与社会实践,对我国消费者网购反悔权的适用障碍进行了探析,进而提出完善我国消费者网购反悔权立法的对策,旨在保障消费者知情权和自主选择权能够有效实现。
Consumers’ right of remorse refers to the statutory contractual right of termination that the intact merchant can return within a statutory period after the consumer purchases the specific merchandise by means of internet. To give consumers the right of remorse is to improve the asymmetric information buyers and sellers in online shopping, the inevitable requirement of fair trade. This article starts from the historical evolution of the consumer’s right of regret, and combines the new methods and social practice to analyze the barriers to the right of consumers to regret it, and then puts forward the countermeasures to improve our country’s consumers’ The protection of consumers’ right to know and the right of independent choice can be effectively realized.
