赣州恒基房地产开发有限公司赣县“美林苑”住宅小区项目为分期建设在建项目,于2007年11月26日取得土地使用证。2011年3月14日,赣县水土保持局对城区范围内的房地产项目进行了水保专项检查,当发现“美林苑”住宅小区房地产项目未办理水保手续时,按照新水土保持法第二十五条、二十六条和第五十三条第二款之规定,对其下达了《水土保持方案催(补)报通知书》。赣州恒基房地产开发有限公司在收到《水土保持方案催(补)报通知书》后,拒不补办手续,并于2011年4月21日向赣县人民政府提出行政复议。最终结果是赣州恒基房地产开发有限公司主动撤诉,并依法补报了《“美林苑”住宅小区项目水土保持方案报告书》,缴纳了3.5万元的水土保持设施补偿费。
