美国肯塔基州高等法院通过罗斯诉更好教育委员会一案的审理,认为肯塔基州公立学校财政资助政策造成了公立学校系统之间教育不充分、不均衡、质量低下,结合对《肯塔基州宪法》中“高效”含义的解释,提出了“高效”的判定标准,从而判定肯塔基州公立学校财政资助政策违反了州宪法,体现了美国教育司法中“平等的受教育权”法律理念的具体化。该案可资借鉴之处在于:教育公平理念的具体化、司法化是保障教育公平的有效途径;对教育公平进行“实质性”的法律解释以形成教育公平的实践判断标准,是实现教育公平司法化的必然要求;建立问责制,督促政府充分履行按标准举办和发展教育的义务,是促进教育公平的必要手段。
