美国宪法《权利法案》第四、五、六条修正案所规定的内容并非仅仅是刑事程序,而是公民的宪法刑事程序权利。美国学界主流观点与司法实务判例对这些修正案的误读,导致有利于罪犯却伤及无辜的后果。通过重新赋予这些条款以宪法权利属性,阿玛尔认为可以避免颠倒事实和压制真相,起到打击犯罪、保护人民的作用,并体现宪法的人民性。对该问题的研究,客观上有利于在回应全球司法改革趋势的前提下,思考我国的司法改革对策,并可帮助廓清宪法权利与公民普通法律权利之间的界限。
The contents of the fourth, fifth and sixth amendments to the Bill of Rights Bill are not merely criminal proceedings, but citizens’ constitutional criminal procedural rights. Misinterpretation of these amendments by the mainstream viewpoints of the American academic community and jurisprudence of judicial practice has led to the criminals being hurt innocent consequences. By re-giving these articles constitutional rights, Amar believes he can avoid reversing the facts and suppressing the truth, playing the role of fighting crime and protecting the people and embodying the constitutional character of the people. The research on this issue objectively helps to reflect on the judicial reform measures in our country and to help clarify the boundary between the constitutional rights and the ordinary legal rights of citizens, on the premise of responding to the trend of global judicial reform.
