注册商标对商品来源的识别作用具有相对性,除非注册商标的知名度和信誉度高、识别能力强.本文指出在判断某种使用商标的行为是否会混淆商品的来源时,需要综合考虑各种因素.本文以一则案例为切入点,对注册商标的识别作用做了简要的分析和探讨.
