政府绩效管理是一个内涵丰富、指涉广泛的新型管理方式,人们可以从不同角度进行研究。在国内,经过对绩效管理弊端的多年反思,虽然以立法推进政府绩效管理获得了学界普遍认同,但绩效管理立法的主体定位和立法框架,则很少受到人们的关注。从绩效管理的监督功能这一本质属性为视角进行研究,政府绩效管理立法的制定主体只能是权力机关而非政府,而且目前由省级人大制定更为适宜;而立法框架则应由立法的目的、目标和原则、管理主体、管理内容等要素构成。
Government performance management is a new type of management method with rich meaning and extensive remarks. People can study from different angles. In China, after many years of introspection on the drawbacks of performance management, although it has been universally accepted by the academic circles to promote the government performance management by legislation, the main body of the performance management legislation and the legislative framework have drawn little attention. From the essential attribute of supervision function of performance management, the main body of government performance management legislation can only be the authority rather than the government, and it is more suitable for the provincial people’s congress at present to make. The legislative framework should be based on the legislative Purpose, objectives and principles, management, management content and other elements.
