从中国加入WTO组织后,我国在吸引外国公司来华投资的同时,也吸引了大批外籍人士来华就业。随着外国及港澳台人士来华工作人数逐年上升,人才流动的日趋国际化,外国劳动力与用人单位的劳动争议纠纷也相应地增加。这类劳动争议纠纷已成为我国劳动关系中的新问题。解决这一新问题,对调解劳资矛盾、和谐劳动关系、优化投资环境,引进先进的管理理念和现代化技术,加快我国现代化建设的进程具有重大意义。本文旨在剖析我国涉外劳动争议的纠纷,解决我国涉外劳动争议的若干问题。
After China joined WTO, while attracting foreign companies to invest in China, our country also attracted a large number of foreigners to come to China for employment. With the number of foreign, Hong Kong, Maucao people working in China increasing year by year, the flow of talents is increasingly internationalized, and disputes over labor disputes between foreign workers and employers also increase correspondingly. Such disputes over labor disputes have become new problems in our labor relations. To solve this new issue is of great significance to the mediation of the contradictions between labor and capital, the harmonious labor relations, the optimization of the investment environment, the introduction of advanced management concepts and modern technology and the acceleration of the process of China's modernization. The purpose of this paper is to analyze the disputes of our country's foreign labor disputes and to solve some problems of our country's foreign labor disputes.
