美国联邦最高法院在Frederick案的判决中声明,学校可以压制那些有理由认为鼓励使用非法毒品的学生言论。通过对该案诸多疑点的分析论证,在学生的言论自由权问题上应遵循这样的规则:原则上学生的言论自由权和普通人没有任何区别;但是基于学校的管理职权,学生发表的严重扰乱学校教学秩序的言论要加以限制;基于学生的身心发育程度,对于学生发表的可能严重危害身心健康的鼓动性言论要予以限制。
