入世给我国金融服务业的对外开放带来机遇的同时，也带来了挑战，银行业尤是如此。本文首先分析了 WTO规则及其有关协议对我国开放银行业提出的一般与具体要求，结合这些要求进而分析了入世对我国现行银行立法提出的挑战，这种挑战具体表现为它们面对 WTO的相关开放要求所暴露出来的诸多弊端和缺陷，随后针对存在的弊端和缺陷作者进一步提出了完善我国银行立法的思考。
The accession to the WTO brings opportunities to the opening up of China’s financial services industry as well as challenges, especially in the banking industry. This article first analyzes the general and specific requirements of the WTO rules and its related agreements on China’s open banking sector. Combining these requirements, this article analyzes the challenges posed by WTO accession to the current banking legislation in our country. The challenge is manifested in their relevance to the WTO Many shortcomings and deficiencies exposed by the requirements for the opening up are also pointed out. Then, the authors of the existing defects and flaws further put forward the thinking of perfecting the banking legislation of our country.
