台湾地区陆生政策与相关规定体系构建之间的互动为探讨教育政策合法化的程序、规范以及价值观提供了样本。重大教育政策只有完成合法化才有可能获得正当性,大量无视合法化规范的政策活动已经使教育法制建设停滞。教育法治条件下,所有政策活动必须有法律授权与法源支持,在法律制度体系和框架下进行。教育政策必须重视合法化问题。
The interaction between the terrestrial policy in Taiwan and the establishment of the system of relevant regulations provides a sample for exploring the procedures, norms and values of the legalization of education policies. Only when legal education is complete is it possible to obtain legitimacy. A large number of policy activities that ignore the legalization norms have already stalled the construction of the legal system for education. Under the rule of law under education, all policy activities must have the legal authority and legal support, and be conducted under the legal system and framework. Education policy must pay attention to the issue of legalization.
