我国女职工劳动保护立法由于没有科学界定女性特殊生理差异而导致保护失当,忽视女职工的多元化需求,法律责任不完善,缺乏对男性生育劳动保护权的保障,忽视女职工及其家庭照顾子女的需求。为了实现平等,需要科学界定女职工劳动保护的范围,尊重女性的主体性,取消一般女职工劳动禁忌,提高特殊时期的劳动保护水平;细化立法,使得不同阶层的女职工都能真实享受劳动保护,实现结果平等;完善法律责任制度,增加用人单位违法成本;赋予男性生育保护的权利;建立育儿支持用工体系。
