第一条 为规范国有土地使用权出让行为,优化土地资源配置,建立公开、公平、公正的土地使用制度,根据《中华人民共和国城市房地产管理法》、《中华人民共和国土地管理法》和《中华人民共和国土地管理法实施条例》 等法律、法规,制定本规定。 第二条 在中华人民共和国境内以招标、拍卖或者挂牌方式出让国有土地使用权的,适用本规定。 本规定所称招标出让国有土地使用权,是指市、县人民政府土地行政主管部门(以下简称出让人)发布招标公告,邀请特定或者不特定的公民、法人和其他组织参加国有土地使用权投标,根据投标结果确定土地使用者的行为。
