业主委员会的法律地位在理论上存在多种学说,在立法上各国也采取不同的立场。我国《物权法》、《物业管理条例》等法律法规对业主委员会的法律地位没有做出明确的规定,从而导致了实践中业主委员会在内部治理和外部关系协调上陷入困境。通过立法明确业主委员会的法律地位具有必要性,应该将业主委员会界定为非经营性质的团体法人,使其能够享有独立的民事主体地位,独立地承担民事法律责任。
