近几年来,国内外银行业掀起一股践行社会责任的潮流。无疑,银行业践行社会责任不仅是促进社会和谐的必然要求,也是提升自身竞争力的重要途径。不过,跟国外同行相比,国内银行业践行社会责任仍然处于较为滞后的状态,外部督促机制的不足是造成这种状态的重要方面。从法律的视角观之,当前包括相关立法与执行机制的缺陷、政府部门与行业组织的定位不准,以及第三方监督力量的被压抑,严重制约了国内商业银行践行社会责任的发展。由此,完善与银行业践行社会责任相关的立法与执法机制,发挥政府部门与行业组织的督导作用,壮大由非政府组织、新闻媒体、社会大众等在内的第三方力量的监督作用,成为促进国内银行业践行社会责任进步的必要途径。
In recent years, the banking industry at home and abroad set off a trend of practicing social responsibility. Undoubtedly, practicing social responsibility in banks is not only an inevitable requirement for promoting social harmony, but also an important way to enhance their own competitiveness. However, compared with foreign counterparts, the domestic banking practice social responsibility is still in a more lagging state, lack of external supervision mechanism is an important aspect of this state. From a legal point of view, the current defects in legislation and enforcement mechanisms, the inaccurate positioning of government departments and trade organizations, and the suppression of third-party supervision have severely restricted the development of social responsibility practiced by domestic commercial banks. In this way, we will improve the legislative and law enforcement mechanisms that are relevant to banking practices in society, give full play to the role of government departments and industry organizations in supervising, and strengthen the supervisory role of third-party forces, including non-governmental organizations, the news media and the general public. It is necessary to promote the progress of social responsibility in domestic banking industry.
