试用期是指包括在劳动期限内的,劳动关系还处于非正式状态,当事人双方进行相互考察的期限。实务中存在着对试用期性质错误理解的情形。关于试用期定性,存在着预约契约说、特别契约说、停止条件说、解除条件说和解雇权保留说等学说。我国《劳动合同法》中对于试用期的定性属于停止条件说,在该说的语境中试用期具有附随性、法律限制性、选择性、适应性等特点。
Trial period is included in the working period, the labor relationship is still informal, both parties to visit each other’s terms. In practice, there is a misunderstanding of the nature of the probationary period. With regard to the qualitative qualifications of the probationary period, there are preconditions of contractual agreement, such as the special contractual agreement, the suspension of conditions, the doctrine of dissolution of conditions and the retention of the right of termination. The qualifications of the probationary period in the Labor Contract Law of our country belong to the conditions of termination. In the context of the said probation, the probationary period has the characteristics of concurrence, legal restriction, selectivity and adaptability.
