未成年人房屋指的是未成年人自己享有所有权的房屋,现在未成年人通过继承,劳动或者受赠等方式都可以获得自己的房产,但是由于他们在年龄上的不成熟和民事行为能力上的受限,经常会涉及到房屋的抵押问题,其中包括,房产所有人的监护人是否可以代替未成年人进行房屋抵押登记行为,债权人是否可以接受未成年人抵押房产等。需要我们对未成年人房屋抵押登记进行多方面的了解,在办理环节上认真考察,才能维护未成年人利益,保证未成年人利益不受侵害。本文叙述了未成年人房屋抵押存在的问题以及法律对未成年人房屋抵押登记的保护制度。
Minors’ houses refer to houses owned by minors themselves. This article describes the problems existing in the mortgage of minors and the protection of the minors’ registration of mortgages by law.
