谢某系某公司职工。1995年12月谢某与该公司签订劳动合同,期限为1995年12月至2000年11月底。合同期满后,谢某继续在该公司工作,公司未提出异议,也没有续签合同。2001年1月份,谢某因病死亡。该公司仅支付丧葬费500元。谢某之子对此有异议,向当地劳动争议仲裁委员会申请仲裁。该仲裁委员会作出裁决:该公司向谢某之子支付一次性救济金6752.50元。该公司不服裁决,2001年3月向人民法院提起诉讼。法院审理后判决该公司向谢某之子一次性支付救济金6752.50元。该公司不服判决,遂提起上诉。二审法院组成合议庭,审理后裁定驳回上诉,维持原判。
Xiemou Department of a company workers. December 1995 Xiemou signed a labor contract with the company, the deadline for the December 1995 to the end of November 2000. After the contract expired, Xie continued to work in the company, the company did not raise objections, nor did the contract be renewed. In January 2001, Xie died of illness.
