期房转让在民间是一种普遍性的操作方式,审判实务中,经常出现结果迥异的判决结果。在物权法出台之前,法律对此基本是持否定态度。随着物权法的出台,物债两分原理得以确认,但对于期房转让行为的效力认识仍旧存在一定的争议。对于不动产领域嵌入极深的公证行业,期房转让是一个无法回避的问题。本文试图以公证视角,对期房转让的合法性争端进行比较评析,并从公证价值出发,为此问题的解决提出一条可行的实施路径。
The transfer of 期房 in the private sector is a universal mode of operation, the trial practice, often results in very different judgments. Before the introduction of the Property Law, the law is basically a negative attitude. With the introduction of the Property Law, the two-point principle of property debt was confirmed, but there is still some controversy about the validity of the transfer of 期房. For the field of real estate embedded in the notarized industry, 期房 transfer is an unavoidable problem. This paper tries to make a comparative assessment of the dispute over the legality of the transfer of 期房 from a notarial perspective, and from a notarial value basis, put forward a feasible implementation path for the solution of this issue.
