随着网络技术和电子商务的飞速发展,网络购物成了大多数人最为接受和喜爱的购物途径,这种跨地域的便捷销售形成了更为广阔的市场,但也不可避免地衍生出来各种法律问题,其中又以商标侵权的现象最为尤甚。文章从商标侵权问题入手,以电商平台间的双十一之争为引例,分析新型电商竞争下商标侵权问题的成因以及其不同于传统交易模式的特殊侵权形式,并着重思考商标侵权的认定标准和商标侵权问题的初步解决措施。
With the rapid development of network technology and e-commerce, online shopping has become the most accepted and favorite shopping way for most people. This convenient transportation across regions has formed a broader market, but inevitably derives a variety of Legal issues, of which the phenomenon of trademark infringement is most particularly.
