大学法学教育国际化,是近20年来中国教育界一直在探索的热点,既是中国法学教育改革的目标之一,也是贯彻实施当前“一带一路”之国家倡议的必然要求。总结历史上法学教育国际化的经验和成果,是开展好这一事业的重要途径。11世纪前后出现的“罗马法复兴”运动导致了中世纪大学的诞生,英国牛津大学与剑桥大学的兴起推动了大学法学教育国际化的开展。尽管在英国法学教育中,罗马法的传授经历了曲折过程,但仍是唯一自中世纪教授至今的科目。罗马法教授在英国法学高等教育中的发展过程,体现了法学教育的国际化进程,即在吸收欧洲大陆法学研究成果的同时保持了英国本土法律教育的特色,从而使英国成为近代以后法律教育的强国之一。
The internationalization of law education in universities is a hot spot that Chinese educational circles have been exploring for nearly 20 years. It is not only one of the goals of the reform of legal education in China, but also an inevitable requirement of implementing the current “One Belt and Roads” initiative. To sum up the experience and achievements of the internationalization of legal education in history is an important way to carry out this undertaking. The “Roman revival” movement that occurred around the 11th century led to the birth of a medieval university. The rise of the universities of Oxford and Cambridge in the United Kingdom promoted the internationalization of university law education. Although the teachings of Roman law have undergone a tortuous process in law education in the United Kingdom, it is still the only subject taught since medieval times. Professor Roman Law’s development in law higher education in the United Kingdom embodies the process of internationalization of law education, that is, it absorbs the research results of law in European continent while maintaining the characteristics of British legal education in the land, making Britain the legal education in modern times One of the great powers.
