检察机关对公安机关刑事执法活动的监督是检察职能的重要组成部分。因其刑事执法活动监督事后监督的滞后性、文证审查的片面性等原因导致刑事执法活动不规范发现难、发现后纠正难等问题。县级公安机关大部分案件集中在公安派出所,加强公安派出所刑事执法活动监督是基层依法治理的必然要求,是司法规范化的现实需要,是提升检察监督能力的迫切需要。目前,基层检察院对公安派出所的刑事执法活动监督存在信息不畅、监督手段缺乏刚性、监督效果不佳等问题,基层检察院需构建以派驻乡镇检察室、检察官办公室、员额检察官直接联系方式为内容的检力下沉监督模式,通过畅通信息渠道、搭建交流沟通平台、强化监督手段等方式加强派出所刑事执法活动监督。
The procuratorial organs’ supervision over the criminal law enforcement activities of the public security organs is an important part of procuratorial functions. Due to the lag of supervising post-supervision of criminal law-enforcement activities and the one-sidedness of the examination of the evidence, the non-standardization of criminal law enforcement activities has led to problems such as difficulty in finding a law enforcement and difficulties in rectification after the discovery. Most cases of county-level public security organs are concentrated in police substations. Strengthening the supervision of criminal enforcement activities in public security police stations is an inevitable requirement of governing at the grass-roots level and is the actual need of judicial standardization. It is an urgent need to enhance the ability of procuratorial supervision. At present, grass-roots procuratorates have inadequate information on the supervision of criminal law-enforcement activities in public security police stations, lack of rigidity in supervision means, and poor supervision results. Grass-roots procuratorates need to set up direct contact with post-procuratorate offices, public prosecutors’ offices, The content of the prosecutorial subsidence supervision mode, through the smooth flow of information channels, to establish an exchange platform for communication, and strengthen supervision means to strengthen police station supervision of criminal law enforcement activities.
