“凶宅”买卖纠纷在现代社会屡见不鲜,然而针对这种纠纷的判例却异彩纷呈。究其原因,一方面是理论界对“凶宅”的定义过于主观导致不准确,另一方面是司法裁判过程中未做到全面、公正。因此,为了提高审判质量,维护司法公正,有必要合理地探讨“凶宅”的本质,并对“凶宅”买卖合同的效力予以客观认定。
“Fierce home ” sale disputes are common in modern society, however, the cases against such disputes are colorful. The reason is that on the one hand, the theoretical circles’ definition of “fierce home ” is too subjective to lead to inaccuracy, on the other hand, the judicial adjudication process is not comprehensive and fair. Therefore, in order to improve the quality of the trial and safeguard the judicial impartiality, it is necessary to probe into the nature of the “dwelling house” rationally and objectively verify the validity of the contract of sale and purchase.
