撒哈拉以南非洲的传统社会一直存在通过调解、调停等友好解决争议的做法,以恢复团体的和平,维持社会的和谐。在殖民统治时期,殖民者在撒哈拉以南非洲引进了西方的争议解决方式,传统的争议解决方式只在当地部族团体内适用。撒哈拉以南非洲国家独立后,一些国家为了实现法律的统一化,对传统争议解决方式没有给予应有的重视。随着传统的友好争议解决方式的价值被人们逐渐认可,撒哈拉以南非洲国家和地区也开始通过立法认可友好争议解决方式,在撒哈拉以南一些非洲国家和地区还设立了许多国内和地区性友好争议解决机构。但撒哈拉以南非洲友好争议解决方式的发展还存在一定的困难,如资金不足、缺乏大量受过培训的调解人员等。考虑到友好争议解决方式对促进撒哈拉以南非洲与其他国家和地区国际商事交往的重要性,撒哈拉以南非洲应采取相应措施鼓励这种争议解决方式的发展。

However, there are still some difficulties in the development of a friendly dispute settlement method in sub-Saharan Africa, such as lack of funds and the lack of a large number of trained mediators. Considering the importance of friendly dispute resolution in promoting international commercial exchanges in sub-Saharan Africa with other countries and regions, sub-Saharan Africa should take appropriate measures to encourage the development of such dispute resolution.
